Failure to Register as a Sex Offender

Sex Offender Registration Laws

If a person has been found guilty of a sex crime and ordered to register as a sex offender, they must adhere to strict laws regarding registration. These laws have changed over the past several years. Most recently, the Ohio State Supreme Court ruled that the tier classification that was implemented under the Adam Walsh Act is unconstitutional. Offenders who were classified under Megan's Law, then re-classified under the Adam Walsh Act , will now revert to their Megan's Law classification with registration requirements as follows:

  • Habitual Sex Offender and Habitual Child-Victim Offender -registration required once a year for 20 years.
  • Sexual Predator and Child Victim Predator -registration required every 90 days for life.
  • Sexually Oriented Offender and Child-Victim Oriented Offender - required registration once a year for 10 years.

Neighborhood/community notification will vary depending on the classification. Any person sentenced after the Adam Walsh Act went into effect, will be classified under the act's three tier system. An adult classified as a Tier l offender is required to register annually every 15 years, a Tier ll offender must register every 180 days for 25 years and a Tier lll offender must register every 90 days for the rest of their life. Registration laws also include time periods for register when an offender moves from one county to another. If you fail to register, you will face penalties based on the sex offense committed.
